Terms of service
These terms govern your use of ClaimTO, a document preparation and filing service. ClaimTO is not a law firm and does not provide legal advice.
1. Nature of service
ClaimTO prepares, organizes, and submits municipal insurance claim documentation to the City of Toronto on behalf of its users. We are a document preparation service only. Nothing in this agreement constitutes legal representation, legal advice, or a lawyer-client relationship of any kind.
2. No guarantee of outcome — no refunds
ClaimTO makes no representation, warranty, or guarantee that your claim will be approved by the City of Toronto. Claim outcomes are determined solely by the City's Insurance and Risk Management division. All fees are strictly non-refundable once submission has been made, regardless of claim outcome. Our fee covers document preparation and submission only.
3. Accuracy of information
You represent and warrant that all information you have provided is true, accurate, complete, and not misleading. ClaimTO relies entirely on information you provide and has no independent means of verifying it. Submitting false or misleading information to the City of Toronto may constitute fraud and is solely your legal responsibility.
4. Your indemnification of ClaimTO
You agree to indemnify, defend, and hold harmless ClaimTO, its operators, and affiliates from any claim, liability, loss, damage, or expense (including legal fees) arising from: (a) inaccurate, false, or incomplete information you provided; (b) any dispute with the City of Toronto relating to your claim; or (c) your breach of these terms. ClaimTO's total liability to you shall not exceed the fee you paid for this service.
5. Authorized agent
By completing the authorization below, you appoint ClaimTO as your authorized agent for the sole purpose of completing and submitting one (1) insurance claim to the City of Toronto on your behalf. This authorization is limited to the specific claim described in your package only.
6. Privacy & data collection
What we collect. We collect only the information required to prepare and submit your claim: your name, contact details, address, incident details, and damage description. We do not collect any information beyond what you voluntarily provide in this form.
How it's used. Your information is used solely to (a) prepare your claim documentation, (b) submit your claim to the City of Toronto's Insurance and Risk Management division, and (c) contact you regarding your submission. It is used for no other purpose.
Who sees your data. Your information is shared with: (1) the City of Toronto, as required to process your claim; and (2) Stripe Inc., solely to process your payment. Stripe's privacy policy governs their handling of your payment data — we never store, see, or have access to your full card number. No other third parties receive your data under any circumstances.
Data security. All data is transmitted over encrypted HTTPS connections. We do not store your payment information. Your personal and claim details are stored securely and accessed only for purposes described above.
Retention & deletion. We retain your submission record for 12 months following your claim submission for dispute resolution purposes, after which it is permanently deleted. You may request early deletion at any time by emailing us at privacy@claimto.ca — we will action all deletion requests within 7 business days. Note that once your claim has been submitted to the City of Toronto, we cannot delete the copy held by the City.
We will never sell, rent, trade, or otherwise disclose your personal information to advertisers, data brokers, or any other third party not named above. We do not use your information for marketing purposes without your explicit consent.
Applicable law. Your personal information is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario privacy legislation.
7. Governing law
These terms are governed by the laws of the Province of Ontario. Any disputes shall be resolved in the courts of Ontario.

I have reviewed my completed claim package and confirm that all information — incident date, location, damage description, and 311 status — is accurate and true to the best of my knowledge.
I authorize ClaimTO to submit this claim to the City of Toronto on my behalf as my authorized agent. I understand ClaimTO is a document preparation service only, is not a law firm, and does not guarantee approval. The $24.99 fee is non-refundable once submitted.
I have read and agree to ClaimTO's Terms of Service above, including the indemnification clause and no-refund policy. I understand that submitting false information to the City of Toronto is my sole legal responsibility.
